These general conditions of use govern the rights and obligations of PhoeniX Equipment and users for any transfer of 3D files intended for 3D printing, free of charge or for a fee, via its website.www.phoenix-equipement.com.

PhoeniX Equipment reserves the right to modify these General Conditions at any time. The applicable T&Cs will be those in force and expressly accepted by the user at the time of downloading the file.
DEFINITIONS
Are considered throughout this document as:
User: any individual who has downloaded a 3D file from the PhoeniX Equipment website.
Creation: refers to all or part of the 3D files available on the site, whether or not they qualify as a work within the meaning of article L122-2 of the Intellectual Property Code.
Printing: processes for manufacturing parts in volume by adding or agglomeration of material, by stacking successive layers using what is generically called “3D printer”.
WARRANTY AND RESPONSIBILITY
The user is required to ensure that the material and the printing technique are compatible with the use he wishes to make of the printed part, this use being in no way dictated by PhoeniX Equipment in the description or the title of the parts resulting from the printing of the 3D files that it offers for download.
PhoeniX Equipment declines all responsibility for the durability and compatibility of the part generated from the suggested model, however, PhoeniX Equipment is committed to the dimensional accuracy of the part subject to the tolerance resulting from printing.
Considering the digital presentation mode of the creations on the Internet network, it is possible that the buyer's perception of the photographic representation of the creations does not correspond exactly to the creation itself once printed. Therefore, if differences in the color of the product, the rendering of the material or the technical adaptation (non-exhaustive list) result from the printing, PhoeniX Equipment cannot be held responsible.
PhoeniX Equipment cannot be held responsible for direct, indirect, foreseeable or unforeseeable damages, compensation for moral prejudice, costs, losses, or liabilities of any nature whatsoever that may arise from the use of the files. downloaded or, on the contrary, the impossibility of using the site or its content. In particular, PhoeniX Equipment cannot, if the user decides on his own initiative to use the products resulting from the downloaded files for the protection of his health, be held responsible for direct or indirect damages resulting from the use or not using this product.

INTELLECTUAL PROPERTY
PhoeniX Equipment, the sole holder of the rights to all the files it offers for download, whether free or expensive, prohibits any use of these, in particular commercial, as well as the creation of derivative works. PhoeniX Equipment prohibits the publication of any adaptation of the work. The distribution of downloadable files free of charge can only relate to the original of the work and without any modification, unless obtaining the express written agreement of PhoeniX Equipment.
The end user therefore does not acquire any intellectual property rights over the files offered for download and as such will only enjoy the functional characteristics of the 3D printed work.
In addition, all text, graphics, user interfaces, visual interfaces, photographs, trademarks, designs and models are reserved worldwide under copyright and intellectual property rights; their reproduction, even partial, is strictly prohibited.
Photographs, drawings, models, synthetic images, sketches and any other type of visual support representing an artist's view or a diagram, with or without dimensions, do not enter into the contractual field. The responsibility of the company PhoeniX Equipment cannot be engaged if errors are introduced.
Unless expressly stated otherwise, no content or design of the PhoeniX Equipment website may be copied, reproduced, downloaded, translated, used or distributed in any way.
USE OF PERSONAL DATA
The customer data collected on www.phoenix-equipement.com via the user account is for the sole purpose of processing the order and ensuring customer follow-up. They are not passed on to third parties.
